1. Who we are

2. Eligibility

• You must be at least 18 years old to use the Service. If we learn that you are under 18 we will delete your account immediately.
• You must have the legal capacity to enter into a binding agreement.
• You must not be barred from using the Service under any applicable law, including export controls or sanctions.
• You must not be required to register as a sex offender in any jurisdiction.
• You must use the Service only for personal, non-commercial purposes.

3. Your account

You sign in with an email address and password you control. You are responsible for safeguarding access to that email account and for all activity on your DelbarMe account. Notify us at hello@delbarme.com if you suspect unauthorized use.

You agree to provide accurate, current, and truthful information. Impersonation, fake profiles, and assumed identities are prohibited.

4. License from us to you

Subject to these Terms, we grant you a limited, personal, revocable, non-transferable, non-sublicensable license to download, install, and use the Service for your personal use on devices you own or control. All other rights are reserved.

5. Acceptable use: what you may not do

You agree not to:

• Post, send, or share content that is unlawful, sexually explicit, pornographic, violent, threatening, harassing, hateful, or that depicts or solicits anyone under 18.
• Use the Service to engage in prostitution, escorting, human trafficking, or any commercial sexual activity.
• Discriminate against, harass, or harm other users on the basis of protected characteristics under Norwegian law (likestillings- og diskrimineringsloven), including ethnicity, religion, gender, sexual orientation, disability, or age.
• Impersonate anyone, post photos of other people without their consent, or claim attributes you do not have.
• Solicit money, gifts, or financial support; promote investment schemes, cryptocurrency, multi-level marketing, or any other commercial activity.
• Scrape, copy, or republish other users' profiles, photos, or messages.
• Reverse-engineer, modify, or interfere with the Service or attempt to bypass safety features such as reporting, blocking, or moderation.
• Upload malware, exploit security vulnerabilities, or use the Service to send unsolicited bulk messages.
• Re-register after we have terminated your account.

6. Your content

You keep ownership of everything you submit to the Service ("User Content"), including:

• Profile photos, voice intro, bio, and structured attributes.
• Voice invites you send in Ashnayi, plus the voice replies that turn into a match.
• Chat messages (text, voice clips, image attachments) with matched users.
• Community posts (photos + captions), postcards (short notes that stay visible for 24 hours in the feed but remain on your profile), and comments on posts.
• Halqa (community-circle) messages, posts, and meetups you create or participate in.

By submitting User Content you grant DelbarMe a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (only for technical purposes such as resizing, transcoding, or moderation), and transmit your User Content for the sole purpose of operating, providing, and improving the Service. This license ends when you delete the content or your account, except for content that has been shared with another user, that has expired according to its own lifespan, or that we must retain for legal or safety reasons (see Privacy Policy §6).

You confirm that you have the necessary rights to submit any User Content, that it does not infringe anyone's rights, and that publication of it does not violate any law.

7. Moderation, safety, and reporting

We use automated systems (including Anthropic's Claude vision model) and human reviewers to check unencrypted content (profile photos, community posts, postcards, voice invites, voice intros, and halqa content) before or shortly after it goes live. We may remove content, hide profiles, suspend accounts, and report unlawful activity to the authorities, including child-sexual abuse material to NCMEC (United States) and Kripos (Norway).

End-to-end encrypted content (chat messages between matches and comments on posts) is not scanned by us because we do not hold the keys (see §16 and Privacy Policy §11). Reporting is the primary safety mechanism for this content.

Each profile has a Report and a Block action. Use Report to flag policy violations; use Block to prevent the other person from contacting you. Reports are triaged by our trust-and-safety team within a reasonable time. If a moderation decision materially affects you, you can request human review by emailing hello@delbarme.com.

8. Suspension and termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, behave in a way that endangers other users, or use the Service unlawfully. We may also discontinue features or the Service as a whole for legitimate business reasons. You may close your account at any time in Settings → Delete my account or at https://delbarme.com/delete.

9. We are a connection service, not a screening service

We do not run criminal background checks on users. We do not verify the truthfulness of any profile information beyond optional photo verification. You are responsible for your own decisions about who to meet, when, and where.

Safety tips when meeting in person: meet in a public place, tell a friend where you are going, arrange your own transport, and trust your instincts. If you feel unsafe, contact emergency services on 112 (Norway) or your local equivalent.

10. Subscriptions and purchases

The current Service is free to use. If we introduce paid features in the future:

• Payments will be processed through Apple App Store or Google Play and governed by their respective billing terms.
• For consumer purchases made by EEA users, the Norwegian angrerettloven (Right of Withdrawal Act) gives you 14 days to withdraw from a digital-content purchase, unless you have actively consented to immediate execution and acknowledged that the right of withdrawal is then waived.
• Refund requests are administered through Apple or Google, not by DelbarMe directly.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, and without limiting any rights you have as a consumer under Norwegian law (forbrukerkjøpsloven), we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that any content moderation will catch every violation.

12. Limitation of liability

To the maximum extent permitted by law, and subject to mandatory Norwegian consumer-protection rules that we cannot contract around, our total liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you have paid us in the 12 months before the event giving rise to the claim, or (b) NOK 500. We are not liable for indirect, incidental, consequential, or punitive damages, or for loss of profit, data, goodwill, or other intangible losses. Nothing in these Terms limits our liability for fraud, gross negligence, or death or personal injury caused by our negligence.

13. Indemnity

You agree to defend and indemnify DelbarMe, its officers, and employees against any claim brought by a third party arising out of (a) your User Content, (b) your use of the Service in violation of these Terms, or (c) your violation of any applicable law or another person's rights.

14. Intellectual property

The DelbarMe name, logo, app design, software, and all related materials are owned by DelbarMe or its licensors and protected by copyright and trademark law. Nothing in these Terms transfers ownership of those rights to you. If you believe content on the Service infringes your intellectual property, send a notice to hello@delbarme.com.

15. Governing law and disputes

These Terms are governed by the laws of Norway, without regard to its conflict-of-laws rules. Disputes will be resolved by the ordinary courts of Norway, with Oslo tingrett as the agreed venue. Nothing in this section limits your right as an EEA consumer to bring proceedings in your country of residence under mandatory consumer law, or to use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. End-to-end encryption and PIN recovery

Chat messages between matched users (including text, voice clips, image attachments, and comments on posts) are protected with end-to-end encryption. Your device holds a private key that decrypts messages sent to you. DelbarMe does not hold a copy of that key and cannot read those messages.

You may optionally set a recovery PIN so a new device (fresh install, phone change) can restore your private key. If you set a PIN, we store an encrypted copy of your key wrapped by that PIN. Anyone with your PIN and access to our storage can decrypt it, so:

• Pick a PIN you can remember, and don't share it.
• If you forget your PIN and lose your device, previously encrypted messages become permanently unreadable. We cannot recover them for you.
• Skipping the PIN is your choice: you keep stronger privacy (nothing recoverable server-side) at the cost of losing chat history on device change.

Content that is not end-to-end encrypted (public profiles, photos, community posts, postcards, voice intros, voice invite content, halqa messages, notification metadata) can still be moderated by us and, subject to legal request, disclosed to authorities.

17. Changes to these Terms

We may update these Terms from time to time. Material changes are highlighted in-app on next launch and the previous version is archived at https://delbarme.com/terms/archive. Continued use after the effective date of an update means you accept it. If you do not accept the change, delete your account.

18. Miscellaneous

• Severability. If any provision is held unenforceable, the rest remain in effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms. We may assign them as part of a corporate reorganisation, merger, or sale of substantially all of our assets, on notice to you.
• Entire agreement. These Terms together with the Privacy Policy are the entire agreement between you and us regarding the Service.
